But arrest records for two of the men show the government's stated reason for the raid was to take out #squatters, not #gang members. The documents were included in a motion filed in an ongoing case challenging #warrantless #arrests in #Chicago.

In the documents, #DHS stated "this operation was based on intelligence that there were illegal aliens unlawfully occupying apartments in the building." There is no mention of criminal gangs or Tren de Aragua.

The records confirm "the worst thoughts that we had about the operation," Mark Fleming, the associate director of federal litigation at the National Immigrant Justice Center, told NPR.

"This is the most brazen #unconstitutional #UseOfForce in an operation that I've seen in my entire career," he said. "They have no legal authority to be addressing purported #squatters; that is not within the purview of the #FederalGovernment."

#Congress authorized the first kind of lawsuit in an 1871 #law that most people call §1983. But Congress has not enacted #legislation allowing suits against #federal ofcls for violating the #Constitution.

“It’s an enormous problem that federal officials are in some ways the hardest people to hold accountable for violating people’s constitutional rights, even harder than state & local officials,” said Carolyn Shapiro, a prof at Chicago-Kent College of Law & a fmr solicitor general of Illinois.

#SCOTUS tried to address the gap in 1971 in Bivens v. Six Unknown Named Agents, allowing the victim of an #unconstitutional search by #federal agents to sue them. But the court has essentially abandoned that approach, saying instead that #Congress must act if suits against federal ofcls are to be allowed.
[I personally don’t see this SCOTUS dealing with the issue given their stance on expansive #ExecutivePower]

There's now a #legal #challenge in #Congo to the #Trump #minerals #deal. A group of Congolese #lawyers are alledging that it is #unconstitutional in the #DRC, because it was never presented to #Parliament before signing.

The deal is also a violation of Congolese #sovereignty, and a danger to the #future generations in Congo. The story is not getting enough #media coverage.

Friends of the Congo on Instagram: "A collective of lawyers and human rights defenders (including the A.N.V.C and FIFA-D.H) has officially filed a petition with the Constitutional Court to declare the mining agreement signed with the United States on Dec 4, 2025, unconstitutional.

Why are they suing? Here are the key arguments:

US Veto Power: The agreement establishes a “Joint Steering Committee” that operates by consensus. Petitioners argue this gives the US a de facto veto over Congolese mining projects, alienating our permanent sovereignty over natural resources.

Violation of African Unity: Article 217 of the Constitution only allows a loss of sovereignty to promote African Unity. This deal hands power to an extra-continental power (the USA), which is constitutionally forbidden.

“VIP” Treatment for Americans: The deal creates a “One-Stop Shop” and tax incentives exclusively for “American persons,” violating Article 12 on equality before the law.

Secret Deal: The agreement was signed without a referendum or proper Parliamentary oversight, leaving the Congolese people (the primary sovereigns) in the dark about the future of their own land.

The petitioners are asking the Court to declare this agreement null and void to protect the national heritage.
