Unconstitutional

Federal #immigration officers are asserting sweeping #power to forcibly enter people’s homes without a judge’s #warrant, according to an internal #ICE memo obtained by The AP, marking a sharp reversal of longstanding guidance meant to respect constitutional limits on government searches.

@Nonilex
Isn't this the kind of situation the gun-toters used as their 'why we must have guns' argument?

@Nonilex this feels like escalation. Violence will be used against the agents. This will be reported as immigrants attacking and or killing agents.

This is reckless.

@Nonilex is there any penalty for knowingly violating the constitution besides impeachment?

@Nonilex The fact they kept that memo so close to the chest makes it very, very clear they knew it was wrong.

Hail to the whistleblowers.

The memo authorizes #ICE officers to use #force to enter a residence based solely on a more narrow administrative warrant to #arrest someone with a final order of removal, a move that advocates say collides with #FourthAmendment protections & upends years of advice given to immigrant communities.

@Nonilex

I'm old enough to remember when it felt like solidarity to distribute these ILRC "red cards" to immigrant communities, for guidance about asserting ones Constitution rights, (including not opening the door of their home without a signed judicial warrant slid under the door).
https://www.ilrc.org/redcards

Unsure what even applies anymore 😔, what the current advice is for staying safe. Things are so off the rails.

I hope ILRC's downloadable flyers etc still apply:
https://www.ilrc.org/community-resources/know-your-rights

Know Your Rights | Immigrant Legal Resource Center | ILRC

Red Cards / Tarjetas Rojas | Immigrant Legal Resource Center | ILRC

All people in the United States, regardless of immigration status, have certain rights and protections under the U.S. Constitution. The ILRC’s Red Cards help people assert their rights and defend themselves in many situations, such as when ICE agents go to a home. Special thanks to our many partners who contributed translations in the various languages now available, making these red cards accessible to more individuals.

@Nonilex

That advice says that administrative warrants are not sufficient to enter into private space without approval to arrest someone. Even a signed judicial warrant limits if and when you can blow open the door to a private residence.

The entry issue is about the legal right you have to enter, not about how bad you claim the person inside is. That's why you need to show probable cause to a judge to get your warrant. Here, ICE isn't even arguing someone is a flight risk. Because quotas.
