Both have always taken their cases to trial.

After reviewing the events today, both said
if it were their client they’d advise:

-Seek a plea deal
-Be willing to plead guilty to a lesser crime or a lower sentence
-Accept anything that isn’t de jure LWOP (life with out parole)

In other words, the guys who defend police
officers shooting for a living, think this case
is unwinnable.

They would try to defend his actions, they’d
just try and lower the impact of the
outcome.

Their main sticking point were:

-“l could argue shot number one and hope
for an acquittal or a hung jury - but I can’t
get there on shots 2 and 3”

-“A jury will not get passed the turning of
the wheels”

-“Denying medics throws self defense out
the window”

Obviously there'll need to be a full investigation—and
there may be things we don’t know—but as a former
criminal defense lawyer who worked homicide cases,
my gut tells me this is Second-Degree Murder. As with
all things ICE, every encounter is mishandled.

Everything about how the first officer approached the
vehicle was contra SOP—which is why the driver got
spooked and tried to navigate from the situation. The
second officer blocked her in—again contra SOP—then
made no effort to step aside (though the victim wasn’t
under arrest).

I think the other key thing to remember is that Noem,
Lewandowski, and Miller are deliberately under-training
and mis-training these officers, which underscores that
they should be facing massive legal liability for the
foreseeable results: i.e., homicides of innocent
Americans.

window of a vehicle yesterday, pepper sprayed
the occupants, and arrested them, and shot
another observer in the face today, and
OBSERVERS ARE STILL GOING OUT TO
